RESOLUTION 2004-33

 

ELECTION ADMINISTRATOR COMPENSATION

Montana Association of Counties supports additional compensation for clerk and recorders for election administration duties, when the clerk and recorder is also the election administrator.

 
 

 

 

 

 

 


WHEREAS, the clerk and recorder position is varied and complex and elections have become more complex and difficult to manage in our litigious society; and

 

WHEREAS, Section 13-1-3-1 MCA provides that “the county clerk and recorder of each county is the election administrator unless the governing body of the county designates another official or appoints and election administrator;” and

 

WHEREAS, in counties where another official or appointee serves as the election administrator with additional or separate compensation and the clerk and recorder’s salary in those counties cannot be reduced to compensate the appointed election administrator; and

 

WHEREAS, additional compensation is earned by and should be paid to a county clerk and recorder who also performs the duties of the election administrator,

 

NOW, THEREFORE, BE IT RESOLVED that Section 13-1-301 MCA be amended as follows:

            13-1-301.  Election Administrator

      1)  The county clerk and recorder of each county is the election administrator unless the governing body of the county designates another official or appoints an election administrator.  In counties where the clerk and recorder is also the election administrator, said clerk and recorder may receive additional compensation in the amount of at least $2,000 per year for election administration duties.  …

 

BE IT FURTHER RESOLVED that Section 7-4-2503 MCA be amended as follows:

            7-4-2503.  Salary schedule for certain county officers–county compensation board

                  … 2) (d)  A clerk and recorder who also serves as the county election administrator may receive, in addition to the salary based upon subsection (1), the sum of at least $2,000 per year.  …
