AMENDMENT TO THE STATUTES
REQUIRING BONDING OF COUNTY OFFICIALS AND EMPLOYEES
It is the intent of the Montana Association of Counties and the MACo/JPIA Board of Trustees to support legislation that amends bonding of County Officers and Employees in order to simplify and clarify bond requirements.
Whereas, current statutes require County Officers and employees to be bonded; and
Whereas, the form of bonds must be approved by the County Attorney; and,
Whereas, bonds are provided by public entity self insured pool program authorized by 2-9-211; and
Whereas, the current bond statutes are archaic and complicated relative to today’s insurance market.
NOW, THEREFORE, BE IT RESOLVED, that the Montana Association of Counties and the MACo/JPIA Board of Trustees support: Amending 2-9-504, 2-9-701 and 2-9-703, among other sections, in order to modernize the county bond statutes, remove the County Attorney review requirement, recognize governmental self-insured pools as providers of bond coverage and generally update the appropriate bond statutes.
