RESOLUTION 2004-10

 

 

MONTANA AIRPORT LAND USE ACT

 

It is the intent of the Montana Association of Counties to support the passage of a re-write of current airport land use laws, specifically Title 67, Chapters 4, 5 and 6, M.C. A.

 
 

 

 

 

 

 

 


WHEREAS, many counties own and/or operate airports; and

 

WHEREAS, these counties rely upon both state and federal funding for airport construction and maintenance projects; and

 

WHEREAS, the state and federal agencies require the project sponsors to assure that the county will not allow incompatible land uses in the influence area surrounding an airport; and

 

WHEREAS, the current sections of the Montana Code annotated provide counties with authority to regulate land use in the area around airports and are antiquated and in conflict with other land use regulations.

 

NOW, THEREFORE, BE IT RESOLVED that the Montana Association of Counties supports the passage of a re-write of current airport land use laws, specifically Title 67, Chapters 4, 5 and 6 of the Montana Code Annotated.
